1) Definitions

  • “We/Us”: Chaskah Ltd.
  • “You/Buyer”: The person or business purchasing products from us.
  • “Products”: Goods we supply (including, without limitation, cream/nitro chargers, cylinders, dairy, and related items).
  • “Contract”: The agreement formed when your order is accepted (see Clause 3).

2) Eligibility, Lawful Use & Age Verification

  • You must be 18+ to purchase age-restricted goods.
  • Products must not be used for recreational inhalation or any unlawful purpose.
  • We may conduct KYC/age verification and refuse/cancel orders if checks are unsatisfactory.

3) Orders & Acceptance

  • Your order is an offer to buy. A Contract forms when we send an order confirmation or dispatch the Products.
  • We may decline an order (e.g., due to stock limits, compliance concerns, pricing errors).

4) Product Information

  • Images and descriptions are illustrative; reasonable variations may occur.
  • You are responsible for ensuring suitability for your intended use and for following all instructions and safety guidance.

5) Prices, VAT & Errors

  • Prices are in GBP and usually exclude VAT and delivery unless stated.
  • We may correct obvious errors in price or description. If you do not accept the correction, we will cancel and refund any sums paid.

6) Payment

  • Unless agreed otherwise, payment is in advance at checkout or pro-forma.
  • For approved trade accounts, payment is due within the agreed credit term.
    • We may charge late-payment interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998.
  • We may suspend further deliveries while any amount remains overdue.

7) Delivery, Risk & Title

  • Delivery dates are estimates. We are not liable for delays outside our reasonable control.
  • Risk passes on delivery to your address or your carrier.
  • Title passes when we receive full cleared payment for the Products (and any overdue sums on your account).

8) Inspection, Damage & Returns

  • Inspect goods on delivery. Notify us in writing within 2 working days of any shortages or transit damage (include photos).
  • Faulty items: we will repair, replace or refund/credit at our option once a manufacturing defect is confirmed.
  • For safety/compliance, pressurised gas cartridges/cylinders and any opened, used, or unsealed items are non-returnable, except where faulty.

9) Consumer Cancellations (Online/Phone Sales)

  • If you are a consumer, you have 14 days after delivery to cancel most online/phone purchases under the Consumer Contracts Regulations 2013.
  • Exclusions apply, including:
    • Goods that cannot be safely returned once opened (e.g., pressurised gas cartridges/cylinders once unsealed/used)
    • Items not suitable for return for health/safety reasons if unsealed
  • This does not affect your legal rights for faulty goods.
  • To cancel within 14 days, email info@chaskah.co.uk with your order number.
  • You must return goods at your cost (unless faulty) in resaleable condition.

10) Safety & Compliance (Pressurised Goods)

  • Store cylinders/cartridges upright in a cool, dry, well-ventilated place away from heat sources.
  • Do not pierce, incinerate or exceed recommended temperatures.
  • You are responsible for:
    • Staff training
    • Safe handling
    • Any site-specific risk assessments
  • Always follow manufacturer instructions and local regulations for transport and storage.

11) Warranty

  • We warrant Products will:
    • Conform to their description
    • Be free from material defects at delivery
  • Except as stated, all warranties and conditions implied by law are excluded to the fullest extent permitted.

12) Liability

  • Nothing limits liability for:
    • Death or personal injury caused by negligence
    • Fraud
    • Any liability that cannot legally be limited
  • Subject to the above, we are not liable for:
    • Loss of profit, revenue, goodwill
    • Indirect or consequential loss
  • Our total liability per Contract is capped at the price paid for the Products giving rise to the claim.

13) Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control (e.g., supply-chain disruption, courier delays, labour disputes, epidemics, or changes in law). We may cancel or fairly allocate available stock.

14) Intellectual Property

  • All trademarks and materials remain the property of their respective owners.
  • No licence is granted except as necessary for normal resale (where applicable).

15) Data Protection

We process personal data in accordance with our Privacy Policy.

16) Termination

We may suspend or terminate a Contract if you:

  • Breach these Terms
  • Become insolvent
  • Fail to pay on time

On termination, all sums become immediately due.

17) General

  • Assignment: You may not assign your rights without our written consent.
  • Entire agreement: These Terms plus your order/our confirmation form the entire agreement.
  • No waiver: Failure to enforce rights is not a waiver.
  • Severance: If any clause is invalid, the remainder remains effective.

18) Governing Law & Jurisdiction

  • These Terms and any disputes are governed by the laws of England and Wales.
  • The Courts of England and Wales have exclusive jurisdiction.
